THE WHITE PELICAN CLUB 

These Club Rules, Policies and Charter of The White Pelican club ("Charter") govern the rights and responsibilities of all Members ("Members") of The White Pelican private Membership club (the "Club") located at 4885 Jimmy Buffet Memorial Highway, Vero Beach, Florida 32963 ("Premises"). This Charter may be amended periodically, as determined by Club Management and communicated to the Members by posting on the Club’s Website at www.whitepelicanclub.com.

 

CLUB RULES & POLICIES

The following Club Policies are intended to promote the positive and safe experience of everyone associated with the Club. We consider these policies to have the force of bylaws and requires adherence to accepted standards of conduct and the Club rules to safeguard the use and enjoyment of The White Pelican Club by its Members and their guests. Our team reserves the right to ask a Member or guest to kindly leave the premises if their behavior does not align with the codes of conduct of the Club.

The Club

The White Pelican Club is a private social club that features dining, cocktails, social interaction, special Member programming and events and facilities for special events (“Special Events”). Our primary concern is the well-being of our Members and their ability to enjoy the Club and its Premises.

Hours

The Club hours will be posted on the Club’s website and may be subject to change. The Club may be closed for a specified period or for public holidays, cleaning, or maintenance, or any other reason Club Management deems to justify temporary closure, with notice to Members whenever possible.

Dress Code

Please ensure that you as a Member and your guests represent yourselves in a way that is conducive to the elevated environment of the Club. We foster a relaxed yet refined atmosphere and encourage our guests to opt for smart casual attire. We encourage self-expression with a touch of elegance, allowing you to enjoy the ambiance of our sophisticated Club. Management reserves the right to refuse entry to anyone deemed unsuitably dressed.

Guests

The rights of Members to invite guests to the Club are limited as stated in this Charter. Each Member may bring up to 2 guests into the Club at any time, however no one guest may be admitted more than 10 times in any Calendar year. Additional guests may be permitted as part of a private event or as approved by Club Management in advance. On occasion, a circumstance may require limiting the number of guests, which shall be communicated to the Members whenever possible. Members shall ensure that their guests are aware of the Club Rules & Policies stated in this Charter and can face suspension or termination of their Membership if their guests violate such rules or policies. A Member’s guests may not enter the Club without a Member being present or allow their guests to remain in the Club when they leave. Members are responsible for the conduct and for any unpaid Club charges of their guests. Guests must register with the Club Host or Manager upon arrival. Members must be present with their guests at all times without prior approval.

Reservations

Reservations are strongly encouraged. Tables will be issued at the discretion of Club Management. Only Members may make reservations. Reservations should not be canceled on less than 24 hours’ notice. Reservations may be forfeited if a Member is 15 minutes or more past the reserved time.

Children

The White Pelican Membership is limited to adults 25 years of age and older, however, Members’ children, who are 21 years or older are permitted on the Premises and only when accompanied by their parent Member. Members are responsible for the behavior of their children. Children of Members shall be deemed guests. Persons under the age of 21 years will not be permitted into the Club except with prior approval by Club Management or if accompanied by their Member parent, during designated special club family oriented events.

Transactions

The White Pelican Club is a cashless venue. Payment may be made by credit card or with a credit card on file and shall be settled at the time of purchase or when closing a Member’s tab. An automatic gratuity may be added to all food and beverage service at the Club at Management’s discretion. All transactions must be settled in full before leaving the Club. Members are responsible for their guests’ charges and any open tab will be charged to the Member’s card on file on the date of the transaction.

Philosophy Regarding Club Staff

Our commitment is to carefully select and maintain an experienced, high-quality team of managers and employees at the Club. Their primary focus is the comfort and the positive experience of our Members and their guests. We expect our Members to treat Club staff with appropriate respect and dignity. If a Member or guest has an issue with any employee of the Club, the matter shall be addressed directly to the General Manager or Manager on Duty. A Member may at no time employ a Club Staff Member without prior written permission of Club Management.

Hosting Events

Members may host Special Events in designated areas of the Premises, working with the Club’s Management to arrange dates, times, food, beverage and other aspects of the event. Hosting Members shall comply with all terms and conditions of the Special Event agreement with the Club, which shall be in addition to the terms and conditions of this Charter. From time to time, the Club or selected portions of the Club may be designated as private event spaces. Notice shall be given to Members regarding use of the entire Club for a private event booking whenever possible.

Event Booking and Club Maintenance

There will be instances in which all, or part, of the Club will be closed to Members and their guests for private events or for necessary maintenance, repair, or redecoration work. When we close the Club for private events, please honor and respect the privacy of all bookings occurring in the Club and refrain from communicating any information about the event to third parties in any medium. It is within the Club’s rights not to disclose information about the nature of the private bookings. Where all or part of the Club is closed for maintenance, repair or redecoration work, or where we need to withdraw facilities or services because we consider that they may pose a risk to the health or safety of our Members, guests or staff, or that they are detrimental to the business, we will seek to ensure that any such area, facility or service is reinstated as soon as practicable.

Alcohol Policy

While alcoholic beverages are served throughout the Club and are a part of the Membership experience, we expect all Members to moderate their usage and refrain from disruptive behavior as a result of their consumption of alcoholic beverages. We reserve the right to refuse to serve alcoholic beverage to any Members or guests who appear to be intoxicated. Alcoholic beverage service at the Club will comply with all federal, state and local laws, rules and regulations, including minimum drinking age laws. No food or beverage may be brought in or removed from the premises without the express approval of Club Management.

Smoking Policy

All Members and their guests are obligated to abide by the Club’s smoking policy, and to all applicable no-smoking governmental laws, rules, and regulations. No smoking (including e-cigarettes and vapes) is allowed inside the Club at any time. The Club reserves the right to prohibit or limit smoking in any area of the Club premises at any time at its sole and absolute discretion and reserves the right to designate certain outside areas of the Club premises as smoking areas and to change the location of such areas at any time. However, all Members and their guests are requested to respect the wishes of other Members and their guests with respect to smoking, and to refrain from smoking when requested by Management to do so.

Parking

Members and their Guests are required to park in designated parking areas for the Club only. Valet parking will be provided from time to time. Ride Share to and from the Club is highly recommended and encouraged.

CLUB MANAGEMENT

Non-Solicitation

We will not allow solicitation of Members for business opportunities, for fundraising, to join other organizations, or to promote religious or political causes, nor will we allow the distribution of unsolicited marketing materials to Members or the posting of any notices or advertisements not pre-approved by Club Management.

Anti-Harassment Policy

Sexual harassment or unwanted sexual advances toward Members and/or staff of either sex will not be tolerated. Any Member who is disturbed by any of the conduct described above is urged to report such matters to the General Manager or to any Club Manager on duty. Any offence will be documented, reported to the proper authorities and result in an immediate termination of the associated Membership or the Member’s guest responsible.

Illegal Drugs, Substances & Other Items

Illegal drugs and substances are not permitted on the Premises at any time. No Member or guest shall purchase, use, ingest, possess, sell or otherwise distribute illegal drugs or other substances, or attempt to do any of the same with any Member, or employee of the Club while on the Club premises or in the immediate vicinity thereof. If any such objects are found, the relevant Member and/or guest will be removed from the Club, the Membership in question will be terminated and depending on the circumstances, relevant authorities may be notified.

Gaming

No betting, wagering, or gaming shall take place on the Premises.

Pets

No animals are allowed on the Premises, except as allowed by law.

Neighbors

All Members and their guests are asked to respect our nearby residents by being quiet when entering or leaving the Club premises, or while in the surrounding area.

Liability of the Club and Assumption of Risks

Any and all personal items brought into the Club and left are entirely at the risk of a Member and/or their guests. The Club, its servants and/or agents shall not be liable to any Member or guest for any loss, damage or injury suffered by them or their property howsoever caused, save in respect of death or personal injury to a Member or guest to the extent caused by the negligence of the Club, its servants and/or agents. This is not intended to affect any mandatory rights a Member or guest may have under local law that we cannot legally restrict or exclude.

Accidents and Injuries

We want all our Members and guests to relax and enjoy the activities and facilities available at our Club in safety. Members and their guests agree to observe the Club’s rules and policies, and any signs published or displayed at our Club at any time; and to take reasonable precautions when travelling around the grounds or using the facilities at the Club at all times.

Disciplinary Procedure

Conduct by a Member or guest that is prejudicial to the reputation and character of the Club may result in suspension or expulsion of such Member or guest. Such conduct may include inappropriate, violent, or abusive behavior, or the communication of information concerning the Club’s affairs, Members or their guests in the Club to the media. An expelled Member may not return to the Club as a guest. A refund of the expelled Member’s subscription will be at the discretion of Club Management. Any Member or Members who willfully remove, damage, or destroy any property belonging to the Club, or to Members or guests on the premises of the Club, will be liable to expulsion and/or suspension or termination of their Membership. Every Member binds him/herself to abide by the rules, bylaws, and regulations of the Club at all times upon acceptance as a Member. If the Club considers that any Member’s (or their guests) conduct either inside or outside of the Club premises is, at its absolute discretion, contrary to the interests of the Club, the Club may with immediate effect expel the Member or guest from the Club premises and/or suspend or terminate that Member’s membership without having to give any reason to such Member or guest.

Rights and Privileges of Membership

A Member shall be entitled to all the rights and privileges of the Club granted to a person in their capacity as a Member and shall be bound by the rules and policies of the Club.

Trademark Rights

Members and their guests shall not use the names, logos, colors, trademarks, service marks, photographs, trade dress, or other identifying features of the Club and its affiliates (the' White Pelican Club Marks') without obtaining the specific prior written approval of the Club as to the specific use. You hereby expressly recognize that The White Pelican Club Marks are the valid, unique, and exclusive property of The White Pelican Club, its parent, affiliates and/or subsidiaries. Members and their guests may not produce, use or create, or authorize others to produce, use or create, The White Pelican Club Marks for any purpose whatsoever, including, but not limited to, in any communications, marketing, advertising or other promotional materials (including, but not limited to, brochures, flyers, invitations and e-mail messages) that utilize the White Pelican Club. Marks without The White Pelican Club’s prior written consent.

Amendments to the Club Rules

The White Pelican Club may change the Club rules and policies from time to time, by displaying notification of the change to the Members and also on the Club website.

Interpretation

Club Management shall be the sole authority as to the interpretation of this Charter.

PRIVACY POLICY

Your Personal Information

We will use the personal information you provide us with in connection with your membership, in accordance with our Privacy Policy.

Privacy for Members & Guests

Members and their guests must not approach, disturb or solicit others in the Club with whom they are not personally acquainted. Doing so may lead to suspension or termination of Membership.

Guest Adherence to Policies

Each Member is responsible for ensuring that his or her guests are aware of this Privacy Policy and comply with all other Member rules and policies.

Mobile Phones

To protect the relaxed atmosphere within the Club, Members may not take or make phone calls in the Club, and phones should be set to silent mode. Texting is permitted and calls may be made in designated areas within the Club established by Club Management. Please ensure that your guests adhere to our mobile phone policy.

Permitted use of Devices

Texting and the quiet use of apps on mobile phones, computers and other non-telephone devices are permitted in all areas of the Club at all times (except apps with voice or sound effects that may disturb other Members or guests).

Cameras and Video Recording Devices

To protect our Member’s privacy, the Club has a no-photo or video policy on the Premises. No cameras, video or other recording devices, whether live-streaming or otherwise and whether on a mobile phone or other medium, may be used while in the Club. Members are responsible for ensuring their guests also abide by this rule. The Club reserves the right to take possession of and confiscate any mobile phone, camera, video or other recording device and any photos, videos or other recorded images used or taken while on the Club premises.

Audio/Video sound

Movies, videos, songs, internet calls, presentations and all other audios must only be played through headphones and should not be audible to any other Member or guest present. Internet calls must only take place in designated areas.

Confidentiality

Members will be held accountable if they or their guests disclose or identify any other Members or guests who are in the Club in the public domain, whether in any press or social media platform and on personal blogs. Similarly, Members and their guests must refrain from identifying or describing any private hire or Member event occurring on Club premises. The Club management and all staff Members are required to adhere to the strictest confidentiality standards and pledge to maintain all records and personal information concerning the Members and their guests in the strictest confidence.

Club Events

The Club may film, video or photograph our Member events and activities at the Club for use in our Membership programs, as well as advertising, promotions, public relations, and other commercial/business purposes. If you take part in these interviews or events, you agree to the Club using your name, image, and limited other information. You also consent to the Club publishing any materials produced by, or for the Club for any purpose without your further consent, and you waive your right to receive any payment from the Club in connection with such publication.

CCTV

Members and their guests should be aware that for safety reasons, CCTV will be utilized at the Club.

News Media and Social Media

Except with respect to Special Events as noted below, the Club has a strict no-press policy for Members. Members will be held accountable if they disclose or identify any other Members or guests, who visit the Club to any media written communication, radio, television or online news media. This also includes social media platforms such as Facebook, Instagram, Twitter, LinkedIn, Snapchat, YouTube, Vimeo and on personal blogs. For clarification, this means no posting club-oriented images on social media.

Special Events

Each special event host (“Host”), with the approval of the Club’s Management in charge of the Special Event, will have discretion to determine the privacy policies applicable within the confines of the Special Event venue. Members and guests attending a Special Event must receive Club Management permission before recording, photographing, videotaping, publicizing, mentioning the Special Event in news media (live, print, or digital), social media, and otherwise publicly identifying or describing the Special Event, the Host, or its attendees.

Consent to use Likeliness

From time-to-time, Club-appointed Staff and Photographers/Videographers may be capturing photographically key events. Should you prefer to remain anonymous, please let the Manager on duty know and please position yourself away from the camera. We will do everything we can to respect your privacy and to accommodate your concerns. The Club has the right to film, video or photograph Member events and/or activities for use in our Membership programming, promotions, public relations, and any other commercial/business purposes.

MEMBERSHIP

Membership Application and Admission

Prospective Members must apply for Club Membership by completing the Membership application. The Club’s Membership Committee, which shall be appointed by Club Management, will review each prospective Member, including credit and background checks as well as reference checks to verify that the prospective Member satisfies the criteria established by Club Management from time to time. However, no individual shall be discriminated against by reason of race, color, religion, sex, ancestry, national origin, age, disability, medical condition, sexual orientation, gender identity, or marital status. Prospective Members must complete a Membership application, provide letters of reference (if requested) and participate in interviews, as requested by the Membership Committee. Membership applications, interview notes, and all discussions and proceedings of the Membership Committee shall be confidential and not subject to review by anyone other than Club Management. By completing and submitting your application for Membership via the Club membership process, you agree to be bound by the Club rules and policies. Membership to the Club will be limited as determined by the Membership Committee, however, the Membership Committee meets throughout the year and will admit new Members when space is available. The Membership Committee and Club Management have sole discretion as to who shall become a Member of the Club. You are free to withdraw your application at any time. Should you wish to do so, please contact our Membership Committee at membership@whitepelicanclub.com. If your Membership application is accepted, we will confirm by sending you a ‘Welcome’ email and payment options to secure your Membership. Your annual Membership will commence on the date the Club opens for business or as of the date of your acceptance once the Club is open for business.

Membership Duration

Memberships are non-transferrable, including by cause of death, although a pro rata portion of annual fees (excluding the initiation fee) may be refunded to a deceased Member’s estate. So long as a Member is current on annual fees and all charges incurred at the Club have been settled, the Membership may be renewed at the discretion of Club Management on an annual basis. If a Member elects to withdraw from the Club due to financial necessity or relocation, as confirmed by Club Management, the departing Member shall pay all outstanding charges incurred at the Club and shall be entitled to a pro rata refund of annual fees, but the initiation fee shall not be refundable. A Membership may be terminated at any time at the Club Management’s discretion or for violating provisions of this Charter, engaging in any illegal conduct at the Premises, for committing vandalism at the premises, engaging in altercations, or unreasonably disturbing other Members, guests, Club Staff or neighbors. A Member whose Membership is revoked shall not be entitled to any refund of annual fees or the initiation fee.

Club Dues & Fees

The White Pelican reserves the right to charge Members an initiation fee, annual dues and admission to the Club premises from time to time for special events. The right to amend or waive any such dues or fees shall be in the Club’s sole discretion.

Membership Renewal

Membership is an annual commitment; Members join the Club for a minimum period of one year. Memberships are renewable on an annual basis and renewal is automatic. However, continuation of one’s Membership is up to the discretion of the Membership Committee or Club Management.

Membership Payment

Upon approval or renewal of your Membership, Membership fees become payable immediately. Initiation fees and dues will be charged on the date of acceptance. By providing us with your payment information, you accept and consent to being charged Membership fees on the form submitted to the Club. It is within our discretion to amend our Membership fees at any time, and we will notify Members in advance if there are to be any changes to the amount, date, or frequency of the payment of your Membership fees. Failure to pay annual dues (or any installment thereof) within 10 days of the due date will result in the Membership being designated inactive. ACH payments or checks are preferred; however, we do accept credit card payments which will incur an additional fee passed on by the Club’s Merchant Provider.

Proposing New Members

Members are encouraged to refer or nominate new applicants to join the Club. Please contact membership@whitepelicanclub.com.

Membership Database

It is important for us to have your current details, plus a photograph of each Member in our Membership database. By becoming a Member of The White Pelican Club, you agree that we can hold your personal details and a photograph to use in connection with your Membership. If your contact or payment details change, please reach out to the Membership Committee at membership@whitepelicanclub.com.

Resignation of Your Membership

Should you choose to resign your Membership prior to your annual renewal, you are still responsible for your full annual dues. Refunds will be granted at the discretion of Club Management.

Member Disputes

Any disputes shall require mandatory mediation prior to the institution or maintenance of any litigation of any type whatsoever. Mediation shall occur in Indian River County Florida. The cost of mediation shall be equally split between the parties.

Membership Cards

Digital or physical membership cards must be scanned or presented to check in at Club entry. Members should also expect to present their Membership card to start a tab within the Club. Any Member who allows their card to be used by a non-Member risks termination of their Membership, and the non-Member will be denied access to the Club.

Membership Levels

The following are currently the levels of Membership at The White Pelican Club:

Founding Members

Founding Members are a select group of initial Members limited to the first 100 Members approved for membership to The White Pelican Club. Benefits include invitations to pre-opening and special events, tastings and surveys. Founding Member’s will also receive discounts and priority access to rare and limited release wine and spirits in the Liquor Library. As a Founding Member you will have the right to nominate two prospective Members for consideration, subject to final approval by the Membership Committee or Club Management.

Resident Membership

Resident Members must be older than 25 years of age and will have full access to the Premise and all the privileges of Membership delineated in this Charter. The initiation fees and annual dues payable by Resident Members are established by the Membership Committee and subject to change at any time.

Spousal Membership

Spousal Members must be older than 25 years of age, married and/or reside together and will have full access to the Premise and all the privileges of Membership delineated in this Charter. The initiation fees and annual dues payable by Resident Members are established by the Membership Committee and subject to change at any time.

Roosevelt Membership

The Roosevelt is a Lifetime Membership to The White Pelican Club. To inquire about details, please contact the Membership Committee at membership@whitepelicanclub.com.

Community Partner

Individuals who have been invited to enjoy a complimentary or reduced fee that grants a limited Membership at the Club in order to enhance the cultural experience and diversity of our Members.

Reciprocal Memberships & Arrangements

The Club may enter into reciprocal Memberships and arrangements with other clubs or organizations on such terms as it shall decide from time-to-time and any such arrangements may be terminated or modified by the Club at any time. Such reciprocal arrangements and opportunities will be communicated to Members and available on the Club’s website.

Future Membership Levels

Club Management may create additional levels of Membership in the future, and delineate the fee structure, privileges and benefits of those Members in an amendment to this Charter at its sole discretion.
